California inmates permitted benefits of same sex marriage law

California prison officials opened the doors to allow inmates to marry people of the same sex under a certain set of circumstances. The decision comes on the heels of the United States Supreme Court decision that made same-sex marriages legal again in California. The director of prisons in California issued a memo stating that this court decision applies to people in the penal system.

California was the first state to permit conjugal visits between people who were in same-sex domestic partnerships. Prisoners will not be able to marry other inmates of the same sex. The director of prisons advised this would cause a security threat within the prison system.

The same general rules that exist regarding marriage between persons of an opposite sex are expected to be applied in regard to same-sex marriages. These rules include a process through which an inmate can garner permission to marry in the first instance.
