Considering divorce? How to protect yourself during the process

Divorces are known to take a considerable amount of time before finalization. When couples in California are considering divorce, it is not uncommon for one party to experience anxiety over financial matters during the period before the divorce is finalized. Anxious spouses may find comfort in knowing that there are ways to ensure financial stability during this time.

In cases where one spouse is financially dependent, such as a stay-at-home parent or disabled person, it is understandable that he or she will be concerned. In many marriages, one spouse is responsible for the income and also controls the family finances. It is often in such circumstances that the other spouse may feel overwhelmed.

The law allows a couple to request a temporary support hearing when the divorce case is filed. This is an interlocutory order of support entered before the trial, to protect each spouse's assets while the case is pending. Such orders will prevent inappropriate behavior by both parties. It will serve as a set of rules regarding matters such as who will remain in the family residence and take care of the children, along with details about who will be paying utilities, mortgage and car installments.
