A same-sex marriage protects couples financially and emotionally

While same-sex marriages in California are nothing new, a couple who recently got married in another state explained the advantages of their new marriage compared to their time as an unmarried couple. In addition to experiencing a moral and emotional victory upon being achieving the right to get married, they also secured financial and other security. They have been together in a committed relationship for 13 years, and the legal same-sex marriage only confirmed the love and commitment that was already there.

One aspect that has always been a concern for both spouses was the eventuality of either one being hospitalized, and the other being refused access to the injured or sick party. Under certain conditions, medical facilities will only allow a patient's next of kin access, and regardless of how long a couple has been together, a non-family member will generally not be allowed access. Because of the legal bond after the marriage, this will no longer be a concern.

Financial advantages of their marriage include federal benefits such as Social Security, pension and a number of important tax benefits. As a married couple, they will also qualify for multiple state benefits in their home state of Florida. These include the right to adopt a child, dividing assets in the event of a divorce, along with the possibility of spousal support and more. In addition, they will no longer be denied the available employee benefits for married couples.

California couples who are unsure about the legalities related to a same-sex marriage may benefit from consulting with an experienced family law attorney. Such a consultation will equip them with the relative knowledge and answer any questions they may have. In order to protect the interests of both parties, each spouse should separately retain the services of an attorney to represent them in negotiating and executing a prenuptial agreement.  In addition, an attorney will also guide the couple through the procedures regarding any parental rights issues if there are children involved or contemplated.
