Property division in Slash divorce may prove to be acrimonious

Saul Hudson, better known as Guns N' Roses guitarist Slash, and wife Perla Ferrar have announced their separation after 13 years of marriage. This follows a divorce filing in 2010 and a subsequent reconciliation complete with renewing their wedding vows in 2011. The couple has two sons, ages 12 and 8 respectively. It is reported that the couple has no prenuptial contract, which may affect the property division process.

California is a community property state, meaning that all assets acquired after the date of marriage are community property and should be divided equally between both spouses. The particular separation is reported to be filled with hostility, and the property division process may prove to be contentious. With the help of a legal professional, Perla is apparently trying to determine Slash's income from his album sales since their wedding date in 2001, along with property acquisitions and other assets.

Slash has reportedly released a total of five albums during their marriage -- one of which reached double platinum status. It is reported that Perla lays claim to half of all the marital property. According to media reports, Slash is seeking joint physical custody of the two children.

Couples don't commonly like to consider the likelihood of a divorce when they are planning their marriage. However, California couples may recognize that a prenuptial agreement could serve to avoid the unpleasant and even traumatic aspects of property division in the event of a divorce in the future. With the assistance of a legal professional, an agreement that protects the interests of both spouses can be drafted for signature in the presence of each party's legal counsel.
