Giving children homes in same-sex families

Times are changing and with the changes comes an overall greater acceptance of relationships that are not so cookie-cutter. Even with the acceptance, there come new challenges, particularly getting older legislation to keep up with more relevant considerations. One such consideration in the age of same-sex marriages and divorces is same-sex adoption.

There are major differences across the states that make up the U.S. but California law proclaims that any adult may adopt, gay or straight, lesbian or transgender. Additionally, second-parent adoptions are clearly allowed throughout the state. Moreover, to adopt a child as a legal stepparent.

California state law prohibits gender identity and sexual orientation discrimination. State law takes it a step further and utilizes identical parenting assumptions for all parents whether children are:

  • Biologically born from a partner in a same-sex marriage.
  • Born from two biological parents in a different-sex family.
  • The same-sex married couple raises a child as a unit.
  • The different-sex married couple raises the child as a unit.
  • Prospective children for LGBT would-be parents are considered for adoption or foster care.
