Employer faces court for allegedly not submitting child support

There may be many parents in California who trust that their employers are regularly submitting paycheck withholdings to the the proper agencies. For parents who have child support taken directly from their pay, they may not ever question whether these important payments are going to their children. However, as one recent case demonstrates -- though rare -- not every employer follows through on these orders.

A childcare center recently received notification that it is in contempt for failing to submit child support on behalf of an employee. The money was withheld from the woman's check as per court order. However, the childcare center was not submitting the money to the county's child support enforcement office. The center allegedly chose to make only monthly payments, but it failed to follow through on those over time.

The last payment submitted in May of last year was declined by a financial institution for lack of funds. A representative of the business stated she was aware that the check was not honored, but she did not submit any further payments. A spokesperson for the child support agency stated that this is the first time an employer has faced contempt charges for not disbursing support payments.

The parent whose payments were not disbursed is now working and paying child support again, but the money is now going to make up the arrears that were caused through no fault of her own. The childcare center is scheduled to appear in court in late April. California parents who also experience difficulty in making their payments, or are having problems receiving timely payments, may consult with a family law attorney in order to resolve the issue in the best manner possible for the parties involved.
