Theroux proposes prenup, Aniston says "I don't"

California is a community property state, which means that when a couple gets a divorce each spouse is entitled to half of the marital assets. This is precisely why some of the sources closest to Jennifer Aniston are concerned with her latest marital choice. 

It is not the man that she chose, the venue, the cake, the guests or the flowers but instead the decision to turn down an offer for a prenuptial agreement. It was her fiance that actually made the proposal, understanding that she has a significantly higher net worth than he does. Without a prenup, Aniston's fiance Justin Theroux would be entitled to an estimated $150 million barring any significant changes in net worth. 

According to a source close to the couple, Theroux wanted Aniston to understand that he was in it for her, not her money. He also didn't want to be "branded a gold-digger," said the source. 

Aniston said that she isn't worried about money at all, even though she already went through a significant and public divorce. "I'm choosing love, not money. And people are just going to have to deal with it," said the actress in a statement to the press. 

It is understandable that a prenuptial agreement that sets out terms and protections in the event of a separation or divorce doesn't seem "in-line" with a promise to marry forever. However, a lack of intent to get a divorce shouldn't stop people from ensuring that they are protected in the event that one does.
