The importance of an attorney when getting a divorce

Some California residents may consider foregoing an attorney and handling their divorce on their own. However, this is not always a good idea because divorce can have an enormous impact on someone's future and finances, and there are many ways that not having legal representation can cause problems.

One major area in which an attorney is helpful is asset division. Many states do not split a couple's assets down the middle, and even in those that do, how assets were gained may have an impact on if it is considered marital property. In many cases, not having an attorney could end up causing someone to miss assets that they had the right to keep. Divorce law is often complicated, and dealing with negotiations and figuring out legal requirements can be difficult and stressful. It is up to the individual to file paperwork correctly, and, while a court may review these documents, people can easily end up with an unexpected divorce decree.

Related to this, if someone has a complicated financial situation or children, there are a variety of opportunities for error. Failing to list an asset or debt could cause legal and financial problems that could require legal assistance later on to resolve. Since most people who are divorced are already under enormous amounts of stress, it is easy for these types of mistakes to occur.

There are a number of legal issues that individuals going through a divorce will need to deal with, including asset division, how to handle debts and visitation if there are children. A lawyer could explain how law deals with these issues as well as negotiating on someone's behalf.
