Child custody and support considerations in California

Each divorce is as unique as the couple that files or the family that is affected by it. When a spouse sits down with a divorce attorney for the first time, there are no doubt going to be a lot of questions, especially if children are involved. The parent will likely have a lot of questions surrounding child custody and support.

As noted above, there are going to be a lot of questions that need answers, and many of these are going to depend on the exact circumstances of the case. That being said, there are some generalities that can be shared in a short post in a Sacramento family law blog. For instance, in California, the law presumes that joint custody is in the best interests of the child.

We noted in the previous post that the law presumes joint custody. It is the starting point, but what factors could change this presumption? In a California family court, allegations of domestic violence are a factor that the judge will take very seriously. Another factor that will be considered in this jurisdiction is the wishes of the child.

What are some common rules affecting child support? Under the child support guidelines, child care additions are a mandatory consideration in determining an award. There is also a mandatory deduction for extraordinary medical emergency expenses. These expenses could include physical therapy, braces or asthma treatments. The court will also adjust the support payment based on shared custody.

These are only a few of the rules, options or issues that are associated with child custody. It is only scratching the surface, which is why a parent or spouse seeks the counsel of a family law attorney to help aid the individual in making these decisions.
