Gossip Girl's child custody battle continues after ex's relocatio

California readers may be interested in the ongoing child custody battle between the Gossip Girl star, Kelly Rutherford, and her ex-husband, Daniel Giersch. When Rutherford suspected Giersch of infidelity five years ago, she filed for divorce. She was pregnant with their second child at the time, and the older child was 2 years old. Rutherford gained child custody, and her former husband remained a part of their lives.

All went well until Giersch, who was a citizen of another country, was exiled from the United States in 2012 when U.S. authorities decided to revoke his visa. A family court judge argued that, because he was not allowed in the United States, he would not be able to visit his children. The court made Giersch the custodial parent, stating that Rutherford could travel between the two countries to visit the children.

Rutherford has been traveling between the United States and France, where her German-born ex-husband now resides, to spend time with the children. Her ongoing quest to prevent the U.S. courts to deport the children, and thereby denying her the opportunity for the children to visit her, has been unsuccessful to date. Rutherford claims that the best interest of the children is not always considered in family court.

While all may be aware of this mother’s battle because she is a well-known figure, there are likely many California parents with similar child custody issues -- even if the relocation is between the states and not involving other countries. Obtaining the services of a professional to fight the battle on one’s behalf may be beneficial. Rutherford states that the appeals process can be complicated, and the slightest error in the filing could have the case thrown out of court.
