Billionaire Ken Griffin faces temporary child support claim

Divorce proceedings, whether in California or elsewhere, sometimes take months to finalize. This is often the case when it is a high asset divorce with complicated asset division to be negotiated. It is common for a spouse who has to care for the children to apply for temporary child support to be paid by the other spouse in order to maintain proper care of the children during the pending divorce proceedings.

Dias Griffin recently filed a claim in another state for temporary child support to be paid by her estranged husband, Ken Griffin. The couple has been separated since 2012, and Dias Griffin alleges that she no longer has access to credit cards, bank accounts and the family's vacation homes. During a child support hearing in December, the couple was instructed by the court to arrange mediation to resolve the issue. However, up to the time of the latest filing, the billionaire had apparently failed to present the financial statements required to determine child support.

Dias Griffin alleges in court documents that her estranged husband, the founder and CEO of Chicago investment firm Citadel LLC, is intentionally avoiding the issue. She claims that he is unwilling to document any financial commitment in order to maintain a financial hold over her. She has requested the court to issue an order for temporary child support to enable her to pay expenses related to the children and their care. In addition, she seeks financial support to cover monthly household overheads that include administrative and staff expenses, along with the costs of security.

Regardless of whether a divorce is regarded as a high asset divorce, a spouse who has to take care of a couple's children during the time leading up to the final divorce decree retains the right to apply for temporary child support and spousal support. Sometimes, those issues are best resolved through mediation, while court intervention may be necessary in other circumstances. An experienced California divorce attorney can assist in explaining the applicable law and providing assistance in filing any claims that are necessary.
