More and more couples are drafting prenups

When you take a camping trip to the woods, you might pack a bear repellent along with your tent, fishing gear and other outdoor equipment. Does this mean you are expecting to be attacked by a bear? Of course not. You pack it to prepare for a worst case scenario. The same is true for prenuptial agreements. Many couples think of a prenup as an admission that a divorce is going to happen sometime down the road. In fact, a prenup is just like that bear repellent; it's there just in case.

While a stigma still exists around drafting a prenup, attitudes among couples are changing, especially as women are becoming a greater part of the workforce and are the primary breadwinners in the household in more and more cases. In fact, the American Academy of Matrimonial Lawyers conducted a survey of attorneys who specialize in divorce and found that 63 percent have noticed an elevation in the number of couples drafting prenups. The same survey discovered that in 46 percent of the cases, it was the women who were requesting a prenuptial agreement.

Experts attribute this uptick to the improving economy. Now that real estate is worth more and people are recovering from the downturn, they are more likely to want to keep what they've worked hard for. Interestingly, divorce may have played a part in the changing stigma as well. Harris Interactive did a poll and found that 49 percent of divorced couples indicated that a prenup is a smart bet. Additionally, 15 percent said that they had regrets about not drafting a prenup.
