What is the benefit of mediation for child custody?

One of the most important issues addressed during divorce his child custody. For the most part, custody is based on the best interest of the child. Of course, it is best if parents can arrive at an amicable agreement. However, occasionally a heated custody battle will ensue and in an attempt to avoid damaging a child's relationship with his or her parents, divorcing couples should consider mediation as a less aggressive form of problem resolution.

One of the main benefits of mediation is that the mediator is always a neutral party. This means that the mediator is not personally or professionally invested in either side. Since mediation is a non-adversarial, collaborative approach to problem solving, many divorcing parents may be more open to the suggestions made during these sessions.

Mediation sessions are also held informally and are likely easier to schedule which may help resolve issues much faster than in a court setting. Not only is mediation generally a quicker process; it is typically much less expensive than other means of resolution.

Through the process of mediation, divorcing parents may find that communicating with each other is not as difficult as originally thought. Even divorced parents should expect some level of interaction with each other regarding their children. A successful mediation may help set the tone for future interaction and help divorced parents co-parent more successfully.

As beneficial as mediation is, it may not be for everyone. Divorcing couples facing custody issues are likely experiencing emotional turmoil that may only be compounded through face-to-face interaction. If you are involved in a custody dispute and have tried mediation but have not had success, speaking to an attorney may help successfully resolve the matter.
