What are the benefits of a domestic partnership?

Not every state allows domestic partnerships. In California, domestic partnerships are still common. While many people believe that domestic partnerships are only for same-sex couples, they are options for both same and opposite sex unions. A domestic partnership is similar to marriage but not exactly the same. Its similarities can be seen through the benefits it provides to couples.

Couples united in a domestic partnership are entitled to certain legal benefits similar to marriage. For example, a domestic partner in California would be able to get health insurance coverage through their partner's policy. Likewise, other employment law related rights afforded to married couples are also given to a domestic partner.

In the event one partner falls ill or requires extended medical care, the rights afforded to the couple through their domestic partnership would provide leave to the working partner. In some cases, bereavement leave or maternity care may also be provided. In the event one partner is hospitalized or incarcerated, their domestic partner is allowed visitation rights similar to those granted to married couples.

Both same and opposite sex couples involved in a domestic partnership are provided many rights in the state of California. While these rights create a positive and progressive atmosphere in the state, federal law still does not recognize these unions. For domestic partners reaching retirement age or considering their estate or financial plan, it is important to understand the limitations of these rights. For example, Social Security benefits are not provided to the domestic partner of a deceased recipient. For information regarding the limitations to domestic partnerships and divorce, individuals may benefit from speaking with an attorney well-versed in same-sex relationships.
