Same-sex couples equal on all fronts

Although here in California it has been legal for same-sex couples to adopt children for quite some time, the recent lift in Mississippi's ban on adoption equality marks a new era for same-sex couples. As of April, it is legal for same-sex couples to adopt children in all 50 states. While this development marks, yet another victory in the fight for equality, it also may mark the start of an additional battle during divorce. Children indeed are a blessing, but in the event of divorce, they are an emotional aspect that can become quite complicated.

Same-sex marriage equality means same-sex divorce equality, and when children are involved, couples that were not used to receiving the full extent of the law may be in for somewhat of a surprise. Divorcing parents have substantially more concerns to consider than their childless counterparts. Not only do they have to worry about logistics like where the children will live and who will receive and pay child support, but they also must learn to co-parent with an individual they may not want anything to do with. These concerns during a divorce can make the process more complicated and stressful.

Depending on the situation, divorcing couples with adopted children may be in store for quite a complicated battle. Although every situation is different, even the most civil divorces can be lengthy and complex. These challenges may require the help of an experienced family law attorney. Divorcing parents may wish to take a collaborative approach to their dissolution, or may have to battle it out in court.

No matter what the circumstances are, divorce with children involved is a complicated and highly emotional experience. Parents, no matter their sexuality, may be more successful working through their divorce with the help of a skilled legal professional.
