Can I stay out of court while divorcing?

If you are going through a divorce or even in the early stages of considering one, you likely are experiencing an array of disconcerting emotions. You may have great apprehension about submitting your personal life, your financial life and your children's lives before the eyes of a court and judge and allowing them to issue orders from there.

If this is your primary concern, you may find your spouse shares similar apprehensions and is willing to work with you to ensure the things both of you value are not subjected to scrutiny and detrimental division by someone who does not know anything about your valuation and the material or immaterial allocation within your hearts.

If you can both get on the same page, you may be able to collaborate on your divorce and reach a settlement outside of court. You will then produce a written settlement agreement and will have to attend a rather basic review of this document where a judge may then ask a few rudimentary questions regarding your understanding of what the settlement agreement means to each of you. If the judge is satisfied that the agreement is fair, and you are both comfortable with its provisions, he should sign off on it and finalize your divorce.

It is important to remember that property division can be contentious and child custody even more so, which is why you should procure an attorney in California that is familiar with state laws and provisions during the settlement and all of the caveats that may cause a judge to deny signing off on an order for a more balanced split.
