67-year marriage ending in hotly contested divorce

According to many media sources, the number of baby boomers who are seeking a dissolution of their marriages has increased significantly. While California is a community property state, couples in other states may find it more difficult when they are in the middle of contested divorce proceedings. One couple that has been married for approximately 67 years is caught up in a heated and complex divorce filing of their own.

The 88-year-old wife recently filed for a divorce based on allegations that her husband had been engaged in a long-term affair with a family adviser. She has further claimed that her husband is verbally cruel and is attempting to keep the couple's three children from rightfully running the couple's real estate company. In addition to the wife's petition for divorce, the adult children have sued their father on the grounds that he has attempted to defraud them of millions of dollars as part of their lawful proceeds from running the family business.

The husband has denied all of his wife's allegations and has counter-sued the children. He claimed to possess a document that assured him of the right to run his holdings until he died unless he became mentally incapacitated. However, a judge recently ruled that the document was a forgery and that the children still maintain an 80 percent control over the couple's holdings.

Due to the age of the wife, her attorney requested that the judge in the case issue the divorce decree and then work to sort out the division of the assets. However, the judge denied that request based on the relative good health of the woman. This contested divorce case is now scheduled to be heard early in 2018. While the majority of California couples will not face such a complicated process involving a myriad of companies and financial considerations, any contested divorce can leave spouses emotionally drained and unsure of how to proceed.
